General Terms of Service

These General Terms apply to all users of the CarSpot platform. Additional terms apply to Dealers and to the Sell My Car service. Please review the related documents at carspot.ie/terms.
1. Definitions
Throughout these Terms, the following definitions apply:
- "CarSpot," "we," "our," or "us" refers to CARSPOT LIMITED, a private company limited by shares registered in Ireland (Registration Number: 789668).
- "Platform" refers to the CarSpot website, applications, and services.
- "User," "you," or "your" refers to any individual or entity using our Platform.
- "Dealer" refers to car dealerships or sellers registered on our Platform with an account.
- "Listing" refers to vehicle advertisements or offers posted by Dealers on our Platform.
- "Content" refers to any text, images, videos, or other materials uploaded to or displayed on our Platform.
2. Platform Overview
CarSpot is a platform connecting car buyers with dealerships. We do not own, sell, or lease vehicles directly. We provide an online marketplace where Dealers can advertise vehicles and Users can browse listings and contact Dealers. We are not a party to any transaction between Users and Dealers.
All public vehicle listings on CarSpot are supplied by independent dealerships and are marked as Dealer listings. Private sellers use the Sell My Car service, where listings are shared only with verified dealers. CarSpot does not itself sell vehicles unless expressly stated in the relevant listing.
3. User Accounts and Eligibility
3.1 General Users
You must be at least 18 years old to create an account, submit a vehicle through Sell My Car, make a payment, submit a finance application, or otherwise enter into a contract through the Platform. If you are under 18, you may browse listings but must not create an account or submit any paid or contractual request.
3.2 Dealer Accounts
To register as a Dealer, you must:
- Be a business, sole trader, partnership, or company lawfully carrying on vehicle sales in Ireland or Northern Ireland
- Provide accurate and complete information during registration
- Keep your account information updated
- Maintain the security of your account credentials
You are responsible for all activity occurring under your account. You must notify us immediately of any unauthorised use or security breach of your account.
4. Intellectual Property Rights
4.1 Our Intellectual Property
The Platform, including its design, text, graphics, interfaces, and code, is owned by CarSpot and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Platform without our prior written consent.
4.2 User and Dealer Content
By submitting Content to our Platform (including vehicle listings, images, descriptions, and communications):
- You retain ownership of your Content
- You grant CarSpot a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate, and distribute your Content for the purpose of operating and promoting our Platform
- You represent that you own or have the necessary rights
5. Prohibited Activities
When using our Platform, you must not:
- Use the Platform for any illegal purpose or in violation of any laws
- Post false, inaccurate, misleading, deceptive, or offensive Content
- Impersonate any person or entity or misrepresent your affiliation
- Interfere with or disrupt the functionality of the Platform
- Attempt to gain unauthorised access to any part of the Platform
- Use data mining, robots, scraping, or similar data gathering methods
- Circumvent, disable, or interfere with security-related features
- Upload viruses, malware, or other malicious code
- Send spam, chain letters, or unsolicited communications
- Collect or store personal data about other users without consent
- Use the Platform to advertise goods unrelated to vehicle sales
- Submit multiple finance applications for the same vehicle without legitimate intent to purchase
- Manipulate vehicle view counts or other Platform metrics
6. Vehicle Listings and Transactions
6.1 Listing Requirements
Dealers must ensure all vehicle listings:
- Are accurate, complete, and not misleading
- Include clear images of the actual vehicle being sold
- Disclose all material information about the vehicle's condition
- Comply with all applicable laws, including consumer protection rules
- Do not infringe on any third party intellectual property rights
6.2 Transactions and Disclaimers
CarSpot is not responsible for:
- The accuracy of listings or vehicle descriptions
- The quality, safety, legality, or availability of vehicles advertised
- The completion of transactions between Users and Dealers
- Any communication between Users and Dealers
- Any damage, loss, or injury resulting from vehicle purchases
We strongly recommend that Users:
- Verify all vehicle information before making a purchase
- Inspect vehicles in person before completing a transaction
- Obtain a vehicle history report when applicable
- Review all purchase, finance, or lease agreements carefully
7. Finance Applications and Credit Inquiries
When submitting finance applications through our Platform:
- You must provide accurate and truthful information
- You understand that the application will be shared with the Dealer
- You acknowledge that submitting multiple applications may negatively affect your credit score
- You understand that CarSpot does not guarantee approval
- You understand that final financing terms are determined by the Dealer or third-party lenders
CarSpot is not a lender and does not make credit decisions. Finance applications may be handled by the relevant Dealer, lender, broker, or authorised credit intermediary. Where required, credit intermediary details will be provided before an application is submitted.
8. Anti-Abuse and Rate Limiting
To maintain the integrity of our Platform and prevent abuse:
- We implement rate limiting on all API endpoints and submissions
- We monitor for suspicious or automated activity
- We may restrict access for users who violate these Terms
- We use measures to prevent scraping and data harvesting
- We reserve the right to reject fraudulent submissions
9. Limitation of Liability
To the fullest extent permitted by law:
- CarSpot provides the Platform “as is” and “as available” without any warranty of any kind
- We disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability for any claims arising from these Terms or your use of the Platform shall not exceed EUR 100 or the amount you paid to us in the past 12 months, whichever is greater
Nothing in these Terms excludes, restricts, or affects any statutory rights you may have as a consumer under Irish or EU law. These limitations apply only to the extent permitted by applicable law.
The limitations in this section do not exclude or limit liability for:
- Death or personal injury caused by negligence
- Fraud or fraudulent misrepresentation
- Any liability that cannot be excluded or limited by Irish law
10. Indemnification
You agree to indemnify, defend, and hold harmless CarSpot, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable legal fees) arising from:
- Your violation of these Terms
- Your use of the Platform
- Your Content
- Your violation of any laws or the rights of a third party
- Any transactions or interactions you have with Dealers or users
11. Modifications to the Platform and Terms
We reserve the right to:
- Modify, suspend, or discontinue any part of the Platform
- Update these Terms by posting amended terms on our website
Your continued use of the Platform after changes constitute your acceptance of the modified Terms. For substantial changes, we will make reasonable efforts to provide notice, such as a prominent website notification or email notification when practicable.
12. Termination
We may restrict, suspend, or terminate your access to the Platform where we have a legitimate reason to do so, including but not limited to:
- Breach of these Terms
- Engaging in prohibited activities
- Upon request by law enforcement or government agencies
- For technical or security reasons
Dealers may terminate their accounts by contacting us. Upon termination, your right to use the Platform will cease immediately. All provisions of the Terms that by their nature should survive termination shall survive, including intellectual property provisions, warranties, indemnities, and limitations of liability.
13. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of Ireland, without regard to its conflict of law principles.
Any dispute arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the Irish courts.
Before initiating any legal proceeding, you agree to attempt to resolve the dispute informally by contacting us at legal@carspot.ie. If we cannot resolve the dispute within 60 days, either party may initiate formal proceedings.
Online Dispute Resolution (EU consumers): If you are a consumer resident in the EU, you may also use the European Commission's Online Dispute Resolution (ODR) platform to resolve disputes relating to online purchases: ec.europa.eu/consumers/odr. 14. General Provisions
14.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and CarSpot regarding your use of our Platform.
14.2 Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect.
14.3 No Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. The waiver of any such right will be effective only if in writing and signed by an authorised representative of CarSpot.
14.4 Assignment
You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt to assign or transfer these Terms without such consent will be null. CarSpot may assign or transfer these Terms, at its sole discretion, without restriction.
14.5 Force Majeure
CarSpot shall not be liable for any failure to perform its obligations under these Terms where such failure results from any cause beyond our reasonable control, including but not limited to: electronic or communications failure, labour disputes, civil commotion, acts of God, or governmental action.
