Sell My Car Terms

1. Service Description

CarSpot operates a private-seller auction marketplace (“Sell My Car”). Private sellers pay a listing fee (the current fee is shown at checkout) to submit a vehicle for dealer offers. The fee is processed via Stripe. Refunds and cancellation rights are described below and are subject to your statutory rights.

2. Auction Mechanics

Each listing is live for 7 days from when dealers are notified. Dealers submit confidential offers during this window. When the auction closes, the seller receives all offers by email and contacts their preferred dealer directly.

3. Non-Binding Nature

All offers made by dealers are entirely non-binding. No contract of sale is formed through CarSpot. CarSpot is not a party to any subsequent transaction between seller and dealer.

4. Reserve Price

Sellers may set a minimum acceptable price (“reserve price”). This amount is not disclosed to dealers during the active auction. Once the auction closes, each bidding dealer is informed of their bid result and the reserve price is disclosed to them at that point to assist in any subsequent negotiation. The seller's contact details are not shared with dealers at any stage.

5. Refund Policy

Subject to your statutory rights, the listing fee is refunded automatically if no dealer submits a bid within 7 days. If one or more bids are received and the auction results are delivered to you, the fee is non-refundable unless we are required to provide a refund under applicable law. Refunds are issued within 5 to 10 business days to the original payment method.

6. Right of Withdrawal

If you are a consumer, you may have a legal right to cancel this distance contract within 14 days without giving any reason, in accordance with the Consumer Rights Act 2022 and related Irish rules on distance and off-premises contracts. By submitting your vehicle and selecting immediate listing, you expressly request that CarSpot begins providing the Sell My Car service before the end of the 14-day cancellation period.

If you cancel after the service has begun, you may be required to pay for the proportion of the service already provided up to the time you notify us of cancellation. If the service has been fully performed before you cancel, and you previously acknowledged that you would lose your cancellation right once fully performed, you may lose your right to cancel. For this service, full performance occurs when the auction closes and the results are delivered to you.

7. Dealer Participation

Dealers receive listing notifications via our trade alert system. Participation is free of charge. Dealers have no obligation to bid on any listing. Dealer offers are non-binding and do not constitute a contractual commitment to purchase.

8. Data Sharing in Results

When an auction closes with one or more bids, the seller receives each bidding dealer's name, dealership name, email address, and phone number to facilitate direct contact. Dealers consent to this disclosure by participating in the platform. Sellers' contact details are not disclosed to dealers at any stage.

9. No Guarantee of Sale

CarSpot does not guarantee any minimum bid level, the accuracy of valuations, or that a sale will complete. CarSpot is not liable for any failure of a seller-dealer transaction to proceed.

10. Seller Warranties

By submitting a vehicle, you warrant that:

• You are the legal owner of the vehicle or have authority to sell it
• All information provided is accurate to the best of your knowledge
• All photos are genuine and unedited representations of the vehicle
